Canadian spousal sponsorship application

Have you been living and working in Canada for some time now and trying to get your family, specifically partner / spouse and children to live with you here in Canada? If you’re eligible, you can sponsor your spouse, partner or dependent children by applying Canadian spousal sponsorship application to become permanent residents of Canada.

Three types of spousal relationships are eligible under this category.

  1. Spouse: you need to prove that the marriage is legal and valid in Canada and in the country of your residence. Marriage of convenience will consider as misrepresentation.
  2. Common-law Partner: You must prove that you have been living in a conjugal relationship for at least 12 ongoing months. Proof can be rent agreement, joint account, utility bills, testimony from friends and family etc. If for any reason the relationship with your common-law partner comes to an end, he/she will no longer be eligible for the program.
  3. Conjugal Partner: In the relationship there is same level of commitment as marriage, but because of the situation out of there control you are not living together. Has been in a relationship with you for minimum one year. Partner lives outside Canada
  • Can’t live with you in their country of residence or marry you because of significant legal and immigration reasons
  • You’ll need to give proof that you could not live together or get married in your conjugal partner’s country (for example, proof of refused long-term stays in each other’s country).

Relationship between same sex and opposite sex are eligible for this program. Partner should be at least 18 years of age.

The age criteria for Dependent children

  • Applicants should ideally be under 22 years of age.
  • Should not have a spouse or common law partner
  • Children 22 years old or older can be eligible as dependents if they meet both of these requirements:
    • they are unable to financially support themselves due to a mental or physical condition
    • they have been under financial support of their parents before they turned 22 years
  • If you’re sponsoring just your child provided that the child’s other legal guardian/ you partner spouse agrees – your child should be the primary applicant.
  • If the child you want to sponsor has an offspring of their own (your grandchild), you have the scope to include your grandchild as dependent in the application.
  • If you’re sponsoring your spouse or partner and who has a child from another partner/spouse, you will have to name your spouse or partner as the principal applicant and the child as the dependent in the application.

Eligibility criteria for Canadian spousal sponsorship application:

  • 18 years of age or older
  • Have any of the qualifying relationship with the sponsored person
  • Must be a Canadian citizen, Permanent residence, or registered Indian
  • Must sign undertaking to provide financial support and You will not require any social assistance from the government
  • Must sign an agreement with the sponsored person

Application Process:

There are two applications

  1. You must apply to become a sponsor.
  2. Your spouse, partner or child must apply for permanent residence.

Follow the below process:

  1. Complete your application package
  2. Pay all application fee
  3. Submit your application (Send both the sponsorship and the permanent residence applications together at the same time)
  4. Submit additional information like medical, biometric, police clearance during processing

Once application is approved sponsored person will receive Confirmation of Permanent Residence.
